We often tell donors to identify their “tax-heavy” assets for their philanthropic gifts, allowing them the double benefit of income tax deductions and avoidance of taxable income. Highly appreciated assets that are soon to be sold are perfect in this regard. However, recent federal tax cases have demonstrated that, if done incorrectly, pre-sale charitable planning can backfire badly. Brad will discuss these recent cases and provide an overview of how donors should approach gifts of assets prior to a sale.
